ACCEPTANCE: Acceptance of this Agreement by Trendmak Computers Limited is not contingent upon any error or deviation from TMC's standard prices.
PAYMENT: Maintenance contract payment shall be made upon signing of this Agreement and in advance. RENEWAL: The Agreement will remain in force from the date signed until the first day of the renewal year. Thereafter, it will be renewed for yearly periods automatically, and by payment of the invoice submitted at the time of renewal unless terminated as otherwise provided for in this Agreement. TERMINATION: The client may terminate this Agreement or withdraw any unit of equipment from this agreement if written notification is given to TMC 30 days prior to the annual renewal date. TMC may terminate this agreement or withdraw any unit of equipment from this agreement if 30 days written notice is given to the client. TMC reserves the right to withdraw forthwith from this agreement any unit of equipment as to which have been or in TMC's opinion may be repetitive instances of the need for additional repairs as described in EXCLUSIONS subparagraphs (a) and (b). HOURS OF SERVICE: TRENDMAK COMPUTERS agrees to provide maintenance service during TMC's normal business hours 8.00 am – 5.00 pm Mondays to Fridays inclusive.Service may also be carried out on weekends, Public holidays and outside normal business hours at an additional cost to the client.Traveling and accommodation for equipment requiring service outside of a 20 KM radius of Nairobi will also be at an additional cost to the client and at the normal market rates. REPLACEMENT OFSPARE PARTS: All materials, components and parts used shall be genuine manufacturer. TMC's engineers shall be at liberty to adjust, lubricate, repair, alter or replace any item of machinery, as they deem fit. Parts will be supplied on an exchange basis when installed by TMC's service personnel. Replaced parts become the property of TMC. EXCLUSION: Maintenance does not cover: - • Repair of damages or increase in service time resulting from accident, neglect, misuse, and abuse or other than ordinary use. • Replacement of Equipment, which is Non Serviceable as, determined by TMC Engineers.
PERFORMANCE: We shall fulfill this contract fully as per the terms and conditions of our Agreement. However should we be unable to undertake this contract due to unavoidable circumstances, we would refund any monies paid in. |
